TERMS AND CONDITIONS OF SALE

Pricing
MPC pricing is valid only 30 days from the date it is provided unless otherwise noted. New quotes or orders after the 30 days have expired are subject to pricing adjustments based on current market conditions. This has been our policy for 25 years. Due to the commodity nature of polyethylene resin, pricing changes occur based on world wide market supply and demand. Manchester Packaging Company has no control over the timing, frequency, or amount of these price changes. We do not put out blanket notification of pricing changes, though we try to keep our customers informed when they ask for quotes or place orders.
Product Defects and Returns
MPC has established product quality assurance procedures to prevent poor quality or defective product from being shipped. However, in the event you receive product you feel is not as ordered or defective in some way, please contact Customer Service immediately. Please identify the product by your purchase order number or by MPC's invoice number or the MPC job number. Also send a sample of the defective material or we will arrange to visit your facility promptly, when practical. Manchester Packaging Company will replace any defective product on a rush basis, without additional cost, or refund your money. However, we expect the customer to pay for any product used and return any unused product at our cost and discretion. DO NOT SEND PRODUCT BACK WITHOUT PRIOR ARRANGEMENT, AND A RETURN AUTHORIZATION. Manchester Packaging Company will make all necessary arrangements for return shipping.
Age and storage conditions at customer locations vary widely and can cause
1. Absorption of objectionable odors,
2. Fading of printing inks and/or rewetting of inks, and
3. Blocking/sticking of film or bags,
MPC will no longer accept a return of film or bags for any reason, if the material is more than six (6) months beyond the original invoice date. It will be the customer's responsibility to provide proof of age by returning a dated and numbered roll ticket or case label with a sample of the product. MPC prints dated eye-marks on all printed products identifying the month and year of manufacture. This will also be used to determine product age and compliance with this policy. Additionally, it is the customer's responsibility to make returned product available during normal business hours, for pick up by a freight company prearranged by MPC. Failure to make the product available for the prearranged pickup will prevent the issue of credit for the complaint material. No credit will be issued until the product is received by MPC at its facilities.
THE FOREGOING IS MPC'S SOLE WARRANTY. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PURPOSE, ARE EXCLUDED AND DISCLAIMED BY MPC. Customer's exclusive remedy against MPC shall be as set forth above. In no event shall MPC be liable to Customer for consequential damages such as, but not limited to, loss of profit or any other damages, regardless whether the claim for such consequential damages be based on warranty (express or implied), contract, tort or otherwise.
